Supreme Court rules on Motor Finance case

The UK Supreme Court ruled in Hopcraft v Close Brothers, Wrench v FirstRand, and Johnson v FirstRand that motor finance brokers do not owe a fiduciary duty to consumers, overturning a previous Court of Appeal decision. However, the Supreme Court found that lenders may have entered "unfair" relationships with consumers under the Consumer Credit Act 1974 if large, undisclosed commissions created such a relationship. This decision impacts claims for undisclosed commissions on car finance deals made between 2007 and 2021.
